INSTRUCTIONS FOR EXPUNGEMENT OF ARREST RECORD

REQUIREMENTS FOR EXPUNGEMENT OF AN ARREST RECORD
Section 610.122  of the Missouri Revised Statutes (RSMO) lists the requirements for
expungement of an arrest record. It says the Court may grant an expungement if the Court finds
the arrest was based on false information and the following conditions exist:
            1)     There is no probable cause, at the time of the action to expunge, to believe you,
                    the arrested person, committed the offense;
            2)     No charges will be pursued as a result of the arrest;
            3)     You have no prior or subsequent misdemeanor or felony convictions;
            4)     No civil action is pending relating to the arrest or the records sought to be
                    expunged; and
            5)     You did not receive a suspended imposition of sentence [SIS] for the offense for
                    which the arrest was made or for any offenses related to the arrest.
If you received an SIS, the Court cannot grant the expungement. However, after successful
completion of probation, that record is set to confidential status pursuant to RSMO 610. You
may check with the county's criminal department to verify the status of the case.

COMPLETING THE PETITION

A licensed Missouri attorney can prepare and file a Petition for Expungement of Arrest Record.
You will need to obtain a set of your fingerprints on a standard fingerprint card which will need
to be attached to the Petition for positive identification.

FILING THE PETITION AND OBTAINING A HEARING DATE

After the Petition is filed, along with the fingerprint card and the filing fee,* notice will be sent
to each of the parties named in the Petition and a date for Hearing will be set for a Judge to hear
your request.

*there is a filing fee for each petition, and a separate petition is needed for each arrest, unless
they are the same incident [day and agency].
